Joyce & Bittner has instituted a new contingent fee program called the "Flexible Fee Program." The "Flexible Fee Program" is designed to maximize our client's portion of a financial recovery for their personal injuries or wrongful death of a loved one. 
The contingent fee charged by Joyce & Bittner for cases accepted into this program is adjusted based upon when in the legal process a recovery in the case is made. A contingent fee is usually charged as a percentage of the financial recovery. Under our "Flexible Fee Program," the percent of contingent fee charged is lower if the case is settled in the earlier stages of the case. At this time the program is limited to persons injured in car, truck, motorcycle or pedestrian accidents which occurred as a result of the negligent operation of a motor vehicle by another person. Upon request, the firm of Joyce & Bittner will consider other types of personal injury cases for this program.
The program sets the contingent fee percentage based upon whether your case is settled, and when in the process it is settled. Thus, the fee will depend on if the case is settled: (1) before a lawsuit is filed, (2) before your case is listed for trial by the court administrator, or (3) after your case is listed for trial. For example, the contingent fee may be structured so that if the case is settled during period (1) the fee percentage could be set at 25%*. If the case is settled during period (2) the fee percentage could be set at 35%. If the case is settled during period (3) the fee percentage could be set at 40%. Each case is evaluated on its own merits in order to determine whether it will be accepted into the "Flexible Fee Program." If your case is accepted into the program, a written fee agreement will be completed setting forth the exact fee percentages to be applied for each of the three periods.
The "Flexible Fee Program" can really have an impact in cases where there is serious personal injury or death, but only limited insurance coverage available. Joyce & Bittner is able to efficiently and economically represent clients under the "Flexible Fee Program" for a number of reasons.

The "Flexible Fee Program" is similar to the traditional contingent fee agreement in that, there is only a fee due if a recovery made through settlement, award or verdict. If no recovery is made there is no fee due. Also, case costs are advanced under the "Flexible Fee Program" in the same fashion as they are under a traditional contingent fee agreement. If your case is not accepted into the "Flexible Fee Program" our firm may be willing to accept your case under the terms of a traditional contingent fee agreement.
